These Terms and Conditions set out the basis on which Waste Disposal Acton provides waste collection and disposal services within its operating areas in the United Kingdom. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before using our waste removal services.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, business, organisation or other entity that makes a booking with Waste Disposal Acton for waste collection or related services.
Company, we or us means Waste Disposal Acton, the provider of waste collection and disposal services.
Services means any waste collection, removal, transportation, recycling or disposal services provided by the Company to the Customer.
Site means the premises, property or location specified by the Customer where the Services are to be carried out.
Waste means any materials, items, refuse or rubbish that the Customer requests the Company to remove, provided that such materials are legally permitted to be collected and disposed of.
The Company provides waste collection, removal, and disposal services for domestic and commercial Customers by prior booking. Services may include single collections, regular scheduled collections, bulky waste removal, property clearance and related activities, as described at the time of booking.
All Services are subject to availability and to the Customer providing accurate information regarding the type, quantity, and location of the Waste to be collected. The Company reserves the right to decline or modify a booking if the Waste described does not match what is presented at the Site or if it contravenes applicable waste regulations.
Customers may request a booking by telephone, email, or through any booking facility provided by the Company. A booking is only confirmed when the Company has accepted the request, provided a price or estimate, and the Customer has agreed to proceed.
At the time of booking, the Customer must provide accurate details, including:
Full name or business name and contact details.
Collection address and any access requirements or restrictions.
Type, approximate volume or weight, and nature of the Waste.
Preferred date and time window for the Service.
The Customer is responsible for ensuring that the information provided is complete and accurate. The Company may adjust the quoted price if the actual Waste or Site conditions differ significantly from those described at the time of booking.
The Company will use reasonable efforts to carry out the Services on the agreed date and within the agreed time window. However, all times given for attendance are estimates only, and the Company will not be liable for any delay arising from traffic conditions, operational issues, or events beyond its reasonable control.
The Customer must ensure that the Company has safe, adequate and lawful access to the Site at the agreed time. This includes arranging any necessary permissions, permits, parking, or access codes and ensuring that the Waste is easily reachable and not obstructed.
The Customer must ensure that:
The Site is safe for the Company’s staff and vehicles.
There are no hazards that have not been disclosed in advance, such as sharp objects, unsafe structures, or harmful substances.
Any necessary consents from landlords, managing agents, neighbours, or local authorities have been obtained.
If access is not available or the Site is unsafe when the Company attends, the Company may cancel or reschedule the booking and may charge a reasonable call-out or wasted journey fee.
The Customer is responsible for ensuring that the Waste presented for collection complies with all applicable laws and regulations. The Company will not collect or handle prohibited, hazardous, or restricted materials except where this has been explicitly agreed in writing and where the Company is licensed and equipped to do so.
Prohibited materials may include, but are not limited to:
Asbestos or asbestos-containing materials.
Clinical, medical or biological waste.
Explosives, ammunition, fireworks or pressurised containers not declared and accepted in advance.
Corrosive, toxic, flammable or otherwise hazardous chemicals.
Radioactive materials or any other waste that requires specialist handling under applicable regulations.
If the Company discovers prohibited or unsafe materials during a collection, it may refuse to remove such items, adjust the price, or cancel the job. The Customer will remain responsible for any costs or consequences arising from presenting such materials for collection.
Prices for the Services will be communicated to the Customer at the time of booking or upon inspection of the Waste. Pricing may be based on volume, weight, type of Waste, labour involved, access conditions and disposal or recycling costs. Any price provided in advance is an estimate only and may be adjusted if the actual Waste or Site conditions differ from the information supplied by the Customer.
Payment is due in full upon completion of the Service, unless otherwise agreed with the Company in writing. The Company may require payment in advance for certain Services or for new business Customers.
The Company accepts payment by cash, bank transfer, card or any other method notified to the Customer. Where payment is made by card or electronic means, the Customer authorises the Company to take payment for the agreed amount and any additional agreed charges.
For business Customers with approved accounts, invoices are payable within the payment terms specified on the invoice. If payment is not received by the due date, the Company may charge interest on overdue amounts at the statutory rate applicable in the United Kingdom and may suspend further Services until payment is made in full.
The Customer may cancel or reschedule a booking by giving reasonable notice to the Company. Unless otherwise agreed, the following will apply:
If the Customer cancels more than 24 hours before the scheduled collection time, no cancellation fee will normally apply.
If the Customer cancels within 24 hours of the scheduled collection time, the Company reserves the right to charge a cancellation fee to cover administrative, staffing, and travel costs.
If the Customer fails to provide access or is not present where required at the agreed time, the Company may treat this as a late cancellation and charge a call-out or wasted journey fee.
The Company may cancel or reschedule a booking if it is unable to carry out the Service due to circumstances beyond its control, including adverse weather, vehicle breakdown, staff illness, safety concerns, or regulatory issues. In such cases, the Company will notify the Customer as soon as reasonably practicable and will offer an alternative appointment. The Company will not be liable for any indirect loss arising from such cancellation or rescheduling.
By using the Services, the Customer warrants and represents that:
They have lawful authority to request the removal of the Waste from the Site.
The Waste does not include prohibited or unlawfully held materials.
They will not knowingly misdescribe the type, volume, or condition of the Waste.
They will comply with all applicable laws, including those relating to health and safety and waste management.
The Customer will indemnify the Company against any claims, losses, damages, or expenses arising from a breach of these warranties, including any regulatory fines or third-party claims caused by inaccurate information or unlawful Waste.
On arrival at the Site, the Company’s operative may assess the Waste and confirm or revise the price according to the actual materials, volume and access conditions. If the Customer does not accept any revised price, the Company may cancel the Service and may charge a reasonable call-out fee.
Once the Customer has agreed to proceed and any required payment has been made, the Company will load the Waste onto its vehicle, using reasonable care and skill and in accordance with applicable waste regulations. The Company may take photographs of the Site before and after the collection for evidential and quality control purposes.
Title and responsibility for the Waste will pass to the Company once it has been loaded onto the vehicle, except where the Waste is later determined to be prohibited or unlawfully held, in which case the Company may return it or require the Customer to accept its return at the Customer’s cost.
The Company will exercise reasonable care and skill in providing the Services. However, the Company’s total liability to the Customer in respect of any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by the Customer for the specific Service giving rise to the claim.
The Company will not be liable for:
Any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity or loss of reputation.
Any damage to property or possessions that arises from pre-existing defects, inadequate construction, or conditions not reasonably apparent or disclosed before the Service.
Any delay or failure in performance due to events beyond the Company’s reasonable control, including extreme weather, traffic congestion, accidents, or industrial action.
Nothing in these Terms and Conditions shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.
The Company will carry out all waste collection, transport, recycling and disposal activities in accordance with relevant UK legislation and regulatory requirements applicable to its operations. The Company will use appropriately licensed facilities, carriers and disposal routes as required.
The Customer acknowledges that the Company may be required to record, classify and report certain types of Waste in line with statutory obligations. The Customer agrees to cooperate with any reasonable information requests necessary for the Company to comply with its legal duties, including describing Waste types accurately and providing any documentation reasonably required.
The Company may refuse to collect or may return Waste if it reasonably believes that handling or transporting such Waste would breach applicable regulations, licences, or health and safety obligations.
If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing details of the issue and any supporting information. The Company will investigate the complaint and aim to respond within a reasonable time.
The Customer must give the Company a reasonable opportunity to remedy any issue before seeking external remedies, except where this is not legally required. Both parties will use their reasonable efforts to resolve disputes amicably and in good faith.
The Company may collect and process personal data relating to Customers in order to manage bookings, provide the Services, handle payments, and comply with legal obligations. Such data may include contact details, address information, payment details and service records.
The Company will handle personal data in accordance with applicable UK data protection laws and will take reasonable steps to keep such data secure. Personal data will not be shared with third parties except where necessary for service delivery, payment processing, legal compliance, or where the Customer has given consent or where otherwise permitted by law.
The Company may update or amend these Terms and Conditions from time to time to reflect changes in law, regulations, or its business practices. Any updated version will apply to new bookings made after the date on which the revised Terms and Conditions are issued or made available.
Continued use of the Services after any such changes shall constitute the Customer’s acceptance of the updated Terms and Conditions. Customers are encouraged to review the Terms and Conditions periodically.
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, such provision shall be deemed severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
These Terms and Conditions, together with any written confirmation or documentation provided at the time of booking, constitute the entire agreement between the Customer and the Company relating to the Services and supersede any prior discussions, correspondence or understandings.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, subject to any mandatory rights the Customer may have under applicable consumer protection laws.
